New 'Fit' Notes

In April 2010 the Social Security (Medical Evidence) Amendment Regulations come into force.

This will replace the current sick note with a 'fit' note. The format of the certificate will change to allow GP's to record an employees 'fitness' to carry out work.

Under this new system there will be 3 categories of ability to work:

1.Fit for work
2.Not fit for work
3.May be fit for some work now

Where the final category is chosen the GP will need to describe the functional effects of the employees condition and indicate what arrangements are needed to help the employee return to work.

Employers do not have to follow the GP's suggestions.

It may be that this new system will affect contractual sick leave and sick pay policies if a GP recommends reduced working hours.

In the next 6 months it would be a good idea to review policies to ensure you are prepared.
